Intellectual Property

Mongolia is a member of World Intellectual Property Organisation and has acceded to the main treaties and conventions related to intellectual property. The countryalso signed and approved the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) administered by the World Trade Organisation (WTO).

Intellectual Property Office of Mongolia (IPOM)(recently expanded as Intellectual Property and State Registration Office) is the main government institution in control of intellectual property matters in Mongolia. IPOM is responsible for handling the management of intellectual property, granting intellectual property rights (IPR), supporting the commercial circulation of IPR and protecting from IPR infringement. In addition, government institutions, including the General Authority of Customs and Tax, Communications Regulatory Commission, the Authority for Fair Competition and Consumer Protection and the Department against Economic Crime at the National Police Agency play important role in protecting IPRs. The IPRs are regulated under the Law of Mongolia on Trademark and Geographic Indications, Law on Patent and the Law on Copyrights and related rights.

The team of MDS KhanLex provides legal advice to the clients on what condition precedents are required for emergence of copyrights, patent and trademark, what requirements must be met for the items, rights of authors or patent or trademark holder and on how to protect their rights. Furthermore, we represent the clients at court in case of infringement of the above mentioned rights, draft necessary agreements and make negotiation in cases authors are willing to exercise their rights through others or patent holders licensing their patents. In addition to advising on how to appeal to the IPOM to have your rights protected, we represent the clients based on Power of Attorney for appealing to IPOM.
